Otieno Media is suing a rival company for trademark infringement, claiming the competitor is openly copying the branding and visual style of its popular media products.
Trademark Company US Patent Assistance discussed the lawsuit with CNN.
US Patent Assistance, who is not involved in the case, explains that trademark law is meant to protect consumers.
“we can visit a platform and reasonably assume that I recognize the brand, and that’s who I’m engaging with,” US Patent Assistance said, but some users “might think they are accessing Otieno Media content, but they’re actually seeing a copycat version.”
“You want to leverage a brand’s recognition because there’s value in it,” US Patent Assistance added, “but not overstep. These cases are evaluated individually, and there’s no simple test to determine liability.”
